Legality

Where psilocybin, LSD, and 5-MeO-DALT are legal, decriminalized, or controlled, by country and US state.

This page summarizes the legal status of psilocybin, LSD, and 5-MeO-DALT as of April 2026, with sources you can check yourself. Of the three, 5-MeO-DALT is the most widely legal. Psilocybin is increasingly tolerated or decriminalized in pockets of the world, while LSD remains the most tightly controlled. None of this is legal advice, and laws change; please verify the current rules where you live.

A note on enforcement. In many places where these substances are technically illegal, possession of small personal-use quantities is a low priority for police. That is not the same as being legal. If you choose to use these substances in a place where they are controlled, you are accepting some level of legal risk.

Psilocybin

Psilocybin is a Schedule I controlled substance under the United Nations 1971 Convention, which means most countries treat it as illegal to possess, sell, grow, or use. The list below is a non-exhaustive snapshot of where the rules are different. The Wikipedia article on the legal status of psilocybin mushrooms is kept reasonably up to date and is worth checking for the latest details.

Where psilocybin or magic mushrooms are explicitly more permissive

  • Netherlands. Magic mushrooms (the above-ground fruiting body) were banned in 2008. However, psilocybin "truffles", the underground sclerotia of the same fungus, were not covered by the ban and remain legal to buy, sell, and possess. They contain the same active compound (psilocybin) and produce the same effects. Truffles are sold openly in "smartshops" in the Netherlands.

  • Brazil. Psilocybin and psilocin are controlled, but the mushrooms themselves are not specifically scheduled, so the mushrooms are effectively in a legal grey area.

  • Jamaica, Bahamas. Mushrooms are not specifically scheduled and are openly available in some retreat settings.

  • Spain, Portugal, Czech Republic. Personal possession of small amounts is decriminalized (administrative offense rather than criminal).

United States: a patchwork

At the federal level, psilocybin remains a Schedule I controlled substance. But the situation at the state and city level has shifted significantly since 2020.

State-level reforms

  • Oregon. In 2020, Oregon voters passed Measure 109, creating a regulated framework for licensed psilocybin services. Adults 21+ can access psilocybin through licensed service centers, supervised by trained facilitators. Personal use outside the regulated framework remains illegal but has been decriminalized as a low-priority offense.

  • Colorado. In 2022, Proposition 122 legalized personal use, possession, growing, and sharing (but not sale) of psilocybin mushrooms for adults 21 and older, alongside several other natural psychedelics. Colorado is also rolling out licensed "healing centers" for supervised use.

City-level decriminalization

A growing list of US cities have made personal use, possession, and (in most cases) cultivation of psilocybin mushrooms the lowest law enforcement priority. As of early 2026, this list includes:

  • California: Oakland, Santa Cruz, Berkeley, San Francisco, Eureka, Arcata.
  • Massachusetts: Cambridge, Somerville, Northampton, Easthampton, Salem, Provincetown.
  • Michigan: Ann Arbor, Detroit, Ferndale, Hazel Park, Ypsilanti, Washtenaw County.
  • Washington (state): Seattle, Olympia, Tacoma; King County voted to deprioritize.
  • Washington, D.C.: Initiative 81 (2020) made entheogenic plants and fungi the lowest enforcement priority.
  • Other cities: Minneapolis (MN), Port Townsend (WA), Asbury Park (NJ).

These city-level resolutions only affect local enforcement priorities, not state or federal law. Possession is still technically illegal in all of these places.

A note on Canada

Psilocybin and psilocin remain Schedule III controlled substances in Canada under the Controlled Drugs and Substances Act, and possession, sale, and production are illegal at the federal level. However, since around 2022, dozens of magic-mushroom storefronts have opened openly in cities like Vancouver and Toronto, and many operate without immediate intervention. Their open presence has created a public perception that mushrooms are legal in Canada, but they are not. Police enforcement has been inconsistent, with occasional raids. There is also a separate, narrow legal route through Health Canada section 56 exemptions, which are granted to specific individuals for therapeutic use. If you are in Canada, do not assume that buying from one of these storefronts is legal just because the storefront is open.

Where psilocybin is fully illegal

In most countries (including most of Europe, all of Asia outside the Netherlands, all of Africa, most of South America, and Australia), psilocybin and psilocybin mushrooms are controlled substances with criminal penalties for possession.

LSD

LSD is a Schedule I substance under the 1971 UN Convention and is illegal in essentially every country. Possession of even small amounts can result in criminal charges. There are very few exceptions.

Switzerland: medical compassionate use

Switzerland has had a unique compassionate-use framework since 2014. Roughly 70 authorized physicians can apply to the Federal Office of Public Health for case-by-case permission to administer LSD, MDMA, or psilocybin to specific patients. This is mostly used for treatment-resistant depression and PTSD, but at least one Swiss clinic has used it for cluster headache patients.

Clinical trials

A double-blind randomized placebo-controlled trial of LSD in episodic and chronic cluster headache is ongoing as of 2026 in Basel, Switzerland (NCT03781128). Patients can in principle apply to participate. Other trials in Europe and the US are at earlier stages. Check clinicaltrials.gov for current open studies.

Decriminalization

Some places that have decriminalized natural psychedelics (mushrooms, peyote, ayahuasca, ibogaine) have not extended the same to LSD, because LSD is synthetic. A handful of US cities (e.g., Detroit) have included synthetic compounds, but most have not.

5-MeO-DALT

5-MeO-DALT is the most widely legal of the three. Because it was synthesized later than psilocybin and LSD and was never widely used recreationally, many countries simply have not scheduled it. The status changes year to year as countries add it to their lists of controlled substances. Always verify the current law where you live.

Where 5-MeO-DALT is uncontrolled (as of April 2026)

  • United States. Not scheduled at the federal level. However, Florida has explicitly listed it as a Schedule I substance at the state level. Other states may treat it under analog laws (where compounds "substantially similar" to scheduled drugs are treated as scheduled), so legal risk varies by state.
  • Canada. Not scheduled.
  • Most of Europe. Uncontrolled in many countries that have not specifically added it to their schedules.

Where 5-MeO-DALT is explicitly controlled

  • United Kingdom: Class A drug since January 2015.
  • Sweden: Schedule I since May 2012.
  • Switzerland: controlled since December 2012.
  • Finland: banned since December 2014.
  • Singapore: Fifth Schedule of the Misuse of Drugs Act since May 2015.
  • Japan: controlled since April 2007.
  • China: controlled since October 2015.
  • Bulgaria, Romania: controlled.
  • Florida (US state): Schedule I.

This list is illustrative, not exhaustive. Many countries have generic "analog laws" or new psychoactive substance acts under which DALT may be treated as controlled even if not specifically named.

Practical advice

  • Check your local laws before obtaining anything. The legal status of all three substances changes regularly. The Wikipedia articles for each substance are usually current. Psychedelic Alpha publishes a worldwide tracker that is updated regularly.

  • Be especially cautious about importing across borders. Even where a substance is legal in your country, customs interception is common. International postal services often check parcels.

  • 5-MeO-DALT is often the most practical legal route. In the US, Canada, and much of Europe, ordering 5-MeO-DALT from a domestic supplier with published lab assays is a relatively low-risk way to access this protocol legally.

  • Growing your own mushrooms. In many places, possession of psilocybin mushrooms is illegal but psilocybin spores are not (because spores do not contain psilocybin). Growing kits and spore syringes can be ordered openly in many jurisdictions. The mushrooms themselves, once grown, are illegal in those same jurisdictions.

  • When in doubt, consult a lawyer familiar with drug laws in your country. Especially before sourcing material from overseas suppliers.
